Health Data Notice

This Health Data Notice provides further information about why and how Zivala processes health data when you use the Zivala Platform, including the mobile application and associated services. It supplements our Website and App Privacy Notice by explaining in more detail how we use health data, the choices available to you and the protections we apply to this particularly sensitive information. Health data is special category personal data and receives additional protection under applicable data protection law.
Please read this Health Data Notice together with our Website and App Privacy Notice which explains Zivala’s wider processing of personal data including the legal bases we rely on, our use of service providers, international transfers, retention, your rights and how to contact us.
What Is Health Data
Health data is information relating to your physical or mental health including information that reveals your health status. Depending on how you use the Platform this may include:
- Medical conditions, diagnoses, symptoms and health history;
- Treatments, medications, supplements, procedures and clinical outcomes;
- Consultation records, clinical correspondence, test results and other documents you upload;
- Symptom, wellbeing and lifestyle tracking information;
- Health metrics from connected wearable devices and health applications;
- Information you include in AI interactions; and
- Information you choose to include in health stories, posts, comments or other community content.
Lawful Basis for Processing Health Data
We generally process your health data with your explicit consent. This includes where you choose to add health information to the Platform, use health-tracking features, connect a wearable device, use an AI feature or publish health-related content.
In limited circumstances, we may process health data where necessary to comply with a legal obligation, establish, exercise or defend legal claims, protect someone’s vital interests in an emergency, or maintain a safe and trustworthy Platform where permitted by applicable law.
Using Health Information Across Platform Features
Where you choose to enable relevant Platform features, health information you provide in one part of the Platform may be used to provide another feature. For example, health records and tracking information may be used to generate a report, help prepare for an appointment or support an AI interaction.
We will only use health data in this way where you have provided the relevant consent. You can manage available feature settings and permissions within the Platform. We apply data-minimisation measures to our AI features and seek to use only information relevant to the feature or request.
Privacy and Sharing Controls
Your health records, symptom-tracking information, uploaded clinical documents and AI outputs are private by default. You control whether to share or publish content using the visibility settings available in the Platform. If you choose to publish a health story, post, comment or other community content, the information you share may be visible to other users in accordance with the setting you select.
Please consider carefully before making health information available to other users. Other users may retain, copy or share content that is visible to them.
Health Records, Tracking and Connected Devices
You may choose to use the Platform to organise health records, upload clinical documents, record symptoms and wellbeing information and connect supported wearable devices or health applications.
We use this information to provide the features you choose to use including to help you organise health information, track symptoms and generate requested outputs.
Wearable integrations are optional. You can disconnect them through the relevant Platform or device settings.
AI Features
Zivala may offer AI-enabled features, such as AI chat, summaries, reports, appointment preparation and story-drafting assistance.
If you choose to use an AI feature, it may process the information you provide to that feature and, where you have enabled this, relevant health information held in your account.
AI outputs are generated automatically and may be incomplete or inaccurate. They are provided for informational and organisational purposes only. They are not medical advice, diagnosis or treatment recommendations. You should seek advice from an appropriately qualified healthcare professional about medical concerns.
We do not use your personal data to train AI models without your separate explicit consent.
Stories and Community Features
The Platform may allow you to publish health stories, participate in groups, post comments, react to content and communicate with other users.
Information you choose to publish or share through these features may include health information. You control the visibility of your content using the settings available in the Platform.
We may process content shared through community features to operate those features, respond to reports, enforce our community rules and protect users and the Platform.
Community content reflects individual users’ experiences and opinions. It is not medical advice and should not be relied on as a substitute for professional medical advice.
Aggregated and Anonymised Insights
We may use properly anonymised and aggregated information to understand how the Platform is used and to improve its features and services. Where information is genuinely anonymised, it is no longer personal data.
We do not sell personal data or use health data for third-party advertising.
Personalisation
We may use information about your interests and interactions with the Platform to personalise content where permitted by law and in accordance with your settings. Further information is available in the Privacy Notice.
Your Choices and Withdrawing Consent
Where we rely on your consent to process health data, you may withdraw that consent at any time through the relevant Platform settings or by contacting us at security@zivala.health.
Withdrawing consent will not affect the lawfulness of processing carried out before withdrawal. It may mean that we cannot provide particular features that depend on the relevant health data.
Your Rights
Depending on the circumstances, you may have rights to access, correct, erase, restrict or receive a copy of your personal data, object to certain processing and withdraw consent where we rely on consent.
